Terms of Service

Please read these Terms of Service carefully before using ReClaim. By accessing or using the service, you agree to be bound by these terms.

1. Acceptance of Terms

These Terms of Service ("Terms") govern your access to and use of ReClaim, a missed-call SMS automation service operated by ReClaim ("we," "our," or "us"). By creating an account or using the service, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the service.

2. Description of Service

ReClaim automatically sends SMS text messages to individuals who call your business phone number when you are unavailable. The service provisions a dedicated phone number, routes missed calls, and delivers customizable SMS messages on your behalf.

3. Eligibility

You must be at least 18 years old and operate a legitimate business to use ReClaim. By using the service, you represent that you meet these requirements.

4. Your Responsibilities and Acceptable Use

You agree to use ReClaim only for lawful purposes. You are solely responsible for:

  • Ensuring your use of the service complies with the Telephone Consumer Protection Act (TCPA), the CAN-SPAM Act, and all applicable federal, state, and local laws and regulations
  • The content of all SMS messages sent through the service
  • Honoring opt-out requests from message recipients promptly
  • Maintaining accurate business information in your account
  • Keeping your account credentials secure

You may not use ReClaim to send spam, harass individuals, transmit illegal content, or impersonate another person or business.

5. Subscriptions and Billing

ReClaim is offered on a monthly subscription basis. Your subscription begins after the free trial period ends and your payment method is charged. Subscriptions automatically renew each month unless cancelled.

You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period — you will not receive a prorated refund for unused time. All payments are processed by Stripe and are subject to Stripe's terms of service.

6. Free Trial

New accounts may be eligible for a 30-day free trial. A valid payment method is required to start the trial. You will not be charged during the trial period. If you do not cancel before the trial ends, your payment method will be charged the applicable subscription fee.

7. Intellectual Property

The ReClaim service, including its software, design, and content, is owned by us and protected by intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the service for your business purposes. You may not copy, modify, distribute, or reverse-engineer any part of the service.

8. Disclaimers

The service is provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that the service will be uninterrupted, error-free, or that SMS messages will be delivered successfully. Carrier filtering, network outages, or recipient opt-outs may prevent message delivery, and we are not liable for such failures.

9. Limitation of Liability

To the maximum extent permitted by law, ReClaim shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the service. Our total liability to you for any claim shall not exceed the amount you paid us in the three months preceding the claim.

10. Indemnification

You agree to indemnify and hold harmless ReClaim and its officers, directors, employees, and agents from any claims, damages, or expenses (including attorneys' fees) arising from your use of the service, your violation of these Terms, or your violation of any third-party rights.

11. Termination

We may suspend or terminate your account at any time if you violate these Terms or engage in conduct that harms other users or the service. You may terminate your account at any time by cancelling your subscription and contacting us at [email protected].

12. Governing Law

These Terms are governed by the laws of the United States. Any disputes shall be resolved through binding arbitration in accordance with the American Arbitration Association's rules, except that either party may seek injunctive relief in a court of competent jurisdiction.

13. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by email or by posting a notice in the service. Your continued use of the service after changes take effect constitutes acceptance of the revised Terms.
